As the party responsible for the information source, users must read carefully and abide by the Liability Statement on the Access Security for Information Source Network (hereinafter referred to as the “Liability Statement”) before accessing to the Kingsoft Cloud Network. This Liability Statement is the information security rules stipulated by Kingsoft Cloud, which shall be applicable to all users. When using the Internet services provided by the Kingsoft Cloud, they must strictly abide by the following terms:
I. The information operation of information sources users must comply with the Regulations of the People’s Republic of China on the Telecommunications, Measures on the Administration of Internet Information Services, Interim Regulations of the People’s Republic of China on the Management of International Networking of Computer Information Networks, Measures on the Administration of Security Protection of Computer Information Networks Linked to the Internet, and other relevant Chinese laws, decrees, and regulations. Users shall not engage in any illegal business activities, and shall be responsible for their own network information security and have the capacity to assume the liability for information security after network access.
II. Users are not allowed to use the Internet to engage in any criminal activities that may endanger national security and leak state secrets, who shall not produce, copy, publish, or disseminate any information that contains the following content, and shall report to the relevant authorities in a timely manner if they find any of the following criminal activities or harmful information:
(1) Opposing the basic principles established by the Constitution of the People’s Republic of China;
(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;
(3) Damaging the honors and interests of the state;
(4) Inciting ethnic hatred or discrimination, and undermining ethnic unity;
(5) Undermining national religious policies and promoting cults and feudal superstitions;
(6) Spreading rumors, disrupting social order, and disrupting social stability;
(7) Disseminating the obscenity, pornography, gambling, violence, homicide, terror expressly prohibited by the state regulations, or instigating crimes;
(8) Insulating or slander others;
(9) Infringing upon the legal rights and interests of others;
(10) Having the design purpose of using software viruses or other computer codes, files and programs, any Trojan horses, phishing programs or bad plug-ins to interfere with, destroy or limit the functions of any computer software, hardware or communication equipment;
(11) Containing other contents prohibited by laws and administrative regulations.
III. Users shall thoroughly check the contents of all their websites to ensure that there is no pornographic or illegal information (including pornographic websites and mobile media WAP site information). They are not allowed to use URL links and advertising promotion services for pornographic websites, nor to advertise or introduce illegal sex products. No information shall be transmitted that endangers the physical and mental health of young people and violates social morals. If so, Users shall delete such content immediately.
IV. In accordance with the relevant provisions of the Measures on the Administration of Internet Information Services (Order No. 292 of the State Council), China implements a licensing system for operational Internet information services and a filing-for-record system for non-operational Internet information services. Those who have not obtained the permit or failed to perform the filing-for-record formalities shall not engage in the Internet information services. Users of operational information sources shall ensure that they have already obtained the business license for value-added telecommunications of Internet information services. Moreover, users of information sources should thoroughly check the record of all main domain names on the server. If there is no filing-for-record, they shall immediately close the website service of the main domain name. For users who intend to provide an electronic bulletin service, they must submit a special application or record to the local communications authority. The operator of the message board, BBS, or chat room content must have a dedicated person responsible for the security management and for 24-hour inspection and monitoring. If there is a problem, the user shall bear all the liabilities. Before applying for the business license or performing the filing-for-record formalities, those who engage in such Internet information services as the news, publication, education, medical care, medicine and medical instrument, if such services must be reviewed and approved by the relevant authorities in accordance with laws, administrative regulations and other relevant national rules, shall be filed with the local Communications Authority after the review and approval by the relevant competent authorities by law.
V. According to Article 22 of the Measures on the Filing-for-record Administration of Non-operational Internet Information Services (Order No 33 of the Ministry of Information Industry), users who intend to engage in non-operational Internet information services should register with the Ministry of Industry and Information Technology ICP record management system https://wap.miit.gov.cn. Providers of non-operational Internet information services shall ensure the legality of the information provided. Users who have not obtained the license or performed the filing-for-record formalities are not allowed to engage in Internet information services. Users who have obtained the license or have completed the filing-for-record formalities shall not engage in any services beyond the scope on record. If a user publishes a website not filed for record or provides services beyond the scope on record, Kingsoft Cloud shall have the right to terminate the services, and the losses occurred to both parties shall be borne by the user concerned. Moreover, in accordance with Article 23 of the Measures on the Filing-for-record Administration of Non-operational Internet Information Services, the website will be closed and the filing-for-record will be cancelled if the information on record is not true. Users shall promise and confirm that all the filing-for-record information submitted are true and valid, and they will submit the updated information to the filing system in a timely manner when their filing-for-record information changes. If the filing-for-record information is not accurate due to the delayed update, Kingsoft Cloud shall have the right to close the website to which users can access by law. VI. In accordance with the relevant provisions of the Measures on the Administration of Security Protection of Computer Information Networks Linked to the Internet (Order No. 33 of the Ministry of Public Security], interconnected units, access units, legal persons and other organizations using computer information network international networking (including those interconnected units and their affiliated branches across provinces, autonomous regions, and municipalities directly under the leadership of the Central Government) shall, within 30 days from the date that the network is officially connected, handle the filing-for-record formalities in the local acceptance authorities designated by the public security organ of the people’s government of the province, autonomous region, or municipality directly under the leadership of the Central Government. The units listed in the preceding paragraph shall be responsible for reporting the situation on the access units and users accessing this network to the local public security organ for record, and timely reporting the changes of such access units and users in the network. If the units and users violate such provisions, Kingsoft Cloud may disconnect the network and terminate the service upon the request of the public security organ, and the losses occurred to both parties shall be borne by the user concerned.
VII. The information released by a user must comply with national laws and policies on intellectual property rights. The user shall be responsible for the qualifications of the business being carried out, contents of the information published and the copyright thereof, and shall be fully liable for the political, legal and economic disputes arising from the information it operates.
VIII. Users should establish their effective information security and confidentiality management systems and technical safeguard measures, who shall be responsible for their own network information security, and accept the management, supervision and inspection of relevant competent business departments. Kingsoft Cloud shall have the right to check the information disclosed by users through browsing, and asking the unit responsible for information sources to modify and delete the inappropriate content. The user’s information and communication methods shall not affect the security of the public network to which Kingsoft Cloud accesses.
IX. If a user’s system operation or service provided affects the stability and normal operation of the entire network, or major network information security problems occur, Kingsoft Cloud shall have the right to take necessary measures to close the relevant information source access channels. Where the circumstances are serious, Kingsoft Cloud shall have the right to terminate the cooperation business or cancel the agreement with that user, and hold the legal liability of the party responsible for the information source.
X. This Liability Statement is incorporated in the relevant business agreement or service agreement. Any acceptance of any business agreement or service agreement by users shall be deemed as their commitment to abiding by the entire content of this Liability Statement.
Pure Mode
